Foreclosure Defense

  • On a typical case in Alabama, in order for the lender to eject or remove a homeowner from the property after foreclosure, a lawsuit has to be filed in Circuit Court.  
  • Once that is filed, if after reviewing the facts of a case, we determine that there are willful or negligence claims we can bring on behalf of the borrowers against he lender/loan servicing company, we file an Answer on behalf of the client and counterclaims against those entities for wrongful foreclosure, breach of contract, fraud and other violations.  
  • We have been successful in aiding clients in these types of situations for years.  There are other types of mortgage fraud problems, such as violations of the Truth in Lending Act (TILA), Real Estate Settlement Procedures Act (RESPA) and other federal guidelines that govern mortgage loans in our country.  

Bankruptcy Protection

  • Every situation is different for each person that walks into our office.  Our goal is to review your specific facts and determine what options are best for you.  
  • Sometimes a Chapter 7 bankruptcy is the best route to take to discharge all your debts and get a fresh start in life.  
  • A payment plan through Chapter 13  to pay most if not all your creditors back is better suited to saving your home and other assets.
  • If you are a small business, a Chapter 11 (sub Ch 5) may be your best bet in reducing the business debt and to keep your business going.
  • In any situation, our goal is to put you into the right bankruptcy protection to resolve your financial difficulties and have a new outlook on your financial future. 

Student loan discharge

This is new for 2023.

If you qualify for bankruptcy, you may be able to now discharge some if not all of your student loan debt.  This is something new being offered by the Department of Education and only can happen through a bankruptcy.  Please call us today if you have a large amount of student loans and are having problems with your finances.
